These are Cibaria International's online store terms and conditions of use to which all online purchases are subject. We reserve the right to change these terms and conditions at any time, without notice. Any changes will take effect when posted on this website. By using this website you agree to be bound by these Terms and Conditions.
Our online store can only accept orders originating from and for delivery to the United States. Cibaria will confirm receipt of your order by sending an email to you, using the address you supplied when ordering on our website. This email is an acknowledgement and does not constitute legal acceptance by us of your order. You are responsible for ensuring the accuracy of the terms of any order you submit. All orders placed on the Cibaria online store are subject to stock availability. No contract will exist until payment has been received. This will be deemed to be our acceptance of your order and to have been effectively communicated to you. Please note that the only language in which the contract can be concluded is English. We reserve the right not to accept any order.
The representation of colors on your browser may vary from the actual colors. Products are not scale models (except where stated in individual product descriptions).
Any advice and/or recommendations given on this website or otherwise given to you by us, or any of our employees or agents, should be followed or acted upon at your own risk. Every effort is made to ensure that our prices and descriptions are accurate, If an administrative error has resulted in an incorrect price being displayed we reserve the right to correct that price and notify you accordingly. In these circumstances, you will not be bound to continue your purchase. You will be asked to email us to confirm that you choose to proceed at the correct price, however, if you decide not to continue with the purchase, your monies will be refunded to your credit card in full. The repayment of such monies paid to us will be the extent of our liability to you in the event of pricing errors.
Price list, catalogs, and other advertising literature or material used by Cibaria International are intended only as an indication as to price and range of goods offered and no prices, descriptions or other particulars contained therein shall be binding on our online store. Any promotional prices for specific marketing or manufacture's programs shall be available to those qualifying customers at the time of the order.
We reserve the right to change the prices at any time. However, if we accept an order from you, the price will remain the same as the price set out on the relevant page at the time the order is placed.
We accept payment by most major credit cards registered with U.S. addresses. We do not accept cash, personal checks, money orders or ship COD. Upon providing us with details of your chosen payment card and submitting an order, you confirm that you are authorized to use the payment card to pay for the goods on the order and authorize us to deduct from the payment card the full price of the goods and all other payments due such as delivery charges. Payments are to be made in full at the time the Customer places an order.
Delivery of Goods
We will deliver the ordered goods to the address given by you at the time you have made your order. We can only deliver to addresses within the United States. Goods may be delivered either to your home address, to an alternative address or to your work. While every effort is made to deliver the Goods in accordance with the timescales set out, we do not accept any liability for any delay in delivering the Goods which is due to events or circumstances beyond our reasonable control or for any business losses. When you receive the goods, you should check them as soon as possible.
Cancellation and Return
At Cibaria International, Inc. we are constantly striving for ways to better serve our customers. Our goal is your satisfaction. Any product received in damaged or otherwise unusable condition, originating at Cibaria or by a Cibaria contracted carrier, will be replaced by Cibaria at no cost and in a timely manner. ALWAYS INSPECT YOUR SHIPMENT IMMEDIATELY UPON RECEIPT FOR ANY DAMAGES OR MISSING PRODUCT.
Product being returned for any other reason must be authorized by Cibaria and a 15% re-stocking fee will apply. Product Return Requests must be made within 30 days of ship date. Product Return Requests made after 30 days of ship date will not be accepted. Please note: Private Label and Custom made products may not be returned.
According to our Bio-Terrorism policy any product being returned to our facility from a customer must be in its original container with the original product seals still intact. The following procedures must be followed before a credit may be issued:
Customer must call Cibaria and inform us that a return authorization is needed.
The request for return should include the following:
Quantity to be returned
Date of receipt
If Cibaria makes the decision to accept the return a “Customer Return Product Authorization” (CRPA) form will be sent to the customer stating which item(s) are to be returned and in what quantity. The CRPA will include the above information. Copies of this form are to be sent to A/R dept and to the warehouse.
A copy of the CRPA must be included with the return load for it to be accepted into our facility.
The product is to be placed on hold until management decides how to best handle the product.

On the Dock / Pallet Reconfiguration Policy
We are experiencing long lead times primarily due to the state of the worlds' supply chain and products & services demand, we are trying to improve this in every way possible, one of which is to use our time wisely. With that, we are implementing an on the dock / pallet re-configuration policy which states if the order has been palletized and on the dock, then we cannot reconfigure the pallet. This is an interruption to our team and not only takes additional time to re-configure the customers' pallet but it also prohibits our team from packing an additional customers' order.
If the customer truly wishes to not have a product, they can return it, once it's been delivered but will incur a 15% restocking fee. We ask that all of our customers place orders for products that they plan to purchase and use prior to placing the order.

If we fail to enforce any of these conditions, that does not mean that we have waived any of our rights and we retain the right to enforce any of these conditions at any time.
